Wunderstood — Combined Terms of Service & Privacy Policy

1. About Wunderstood

Wunderstood ("Wunderstood," "we," "us," or "our") is a technology and career‑services platform. We offer:

• Professional Coaching — one‑to‑one services delivered by principal‑ and staff‑level experts from leading tech companies;
• Software Tools — browser extensions, web applications, and APIs that use advanced processing (including AI) to analyze, summarize, or transform user‑provided content; and
• Business Solutions — team licenses, custom integrations, and advisory services for organizations.

Independent experts in our network act as contractors and are responsible for their own professional and regulatory compliance.

2. Scope of These Terms

These Terms govern your use of:

• the public website, web applications, and browser extensions located at wunderstood.com and related domains (the “Site”);
• all Professional Coaching services you book through Wunderstood; and
• all Software Tools and Business Solutions we make available, whether self‑serve or by direct agreement.

3. Acceptance of Terms

By accessing the Site, installing our software, or purchasing Coaching or Business Services, you agree to these Terms of Service and Privacy Policy (collectively, the “Terms”). If you do not agree, do not use Wunderstood products or services.

4. Eligibility

• You must be at least 18 years old, or have written parental consent if 13–17.
• You confirm that any information you supply is accurate and that you are authorized to share it.

5. Payments, Subscriptions & Refunds

• Coaching Sessions. Payment in full is required to confirm a session. Refund windows displayed at checkout apply (48 h full refund, 24–47 h 50 %, <24 h no refund).
• Software Subscriptions. Unless stated otherwise, subscriptions renew automatically each billing cycle until cancelled. You may cancel in your account dashboard; access remains until the end of the paid term. We do not offer prorated refunds for unused periods.
• Business & Team Licenses. Payment terms and service‑level agreements are set out in the relevant order form or master service agreement and override this Section 5 if inconsistent.

6. Use of External Processing Tools

To deliver and improve the Services, Wunderstood may transmit your content—including résumés, project files, prompts, code snippets, recordings, and other materials—to third‑party service providers that supply computing, storage, analytics, artificial‑intelligence, transcription, or similar processing capabilities (“External Processors”). These External Processors handle data solely on Wunderstood’s behalf and under their own privacy terms.

• By submitting content, you grant Wunderstood permission to share it with External Processors for the purposes of analysis, transformation, feedback generation, hosting, or quality assurance.
• You are responsible for ensuring you have the right to provide such content and that doing so does not violate confidentiality obligations or law.
• You may withdraw consent to third‑party processing at any time, but doing so may limit our ability to provide certain features or Services.

7. Recordings & Quality Assurance

Live coaching sessions may be recorded for up to 90 days for quality control and to prepare personalized feedback. Recordings are encrypted at rest and are not shared externally without your written consent. You may opt out before a session (note: opting out may limit feedback detail).

8. No Guarantee of Outcomes

All coaching and software outputs are advisory or informational. Wunderstood does not guarantee employment offers, interview invitations, compensation increases, accuracy of generated text, or uninterrupted software uptime.

9. Limitation of Liability

To the fullest extent permitted by law, Wunderstood’s aggregate liability arising out of or relating to any product or service will not exceed the greater of (a) fees paid by you to Wunderstood in the 12 months preceding the claim or (b) USD 100.

10. Intellectual Property

All Wunderstood software, prompts, templates, and materials remain our intellectual property. You receive a personal or organizational license as specified in your order. You may not reverse‑engineer, sublicense, or publicly redistribute outputs without written consent.

11. Privacy & Data We Collect

• User‑submitted content: résumés, documents, chat transcripts, code, recordings.

• Usage & analytics: log files, device IDs, cookies, IP addresses, clickstream data.
• Payment info: processed by Stripe or Intuit; Wunderstood does not store full card numbers.

We use data to deliver and improve Services, comply with law, prevent misuse, and send you relevant product updates (you may opt out of marketing emails).

12. Security

Wunderstood employs reasonable administrative, technical, and physical safeguards. No online system is completely secure; you use the Services at your own risk.

13. Governing Law & Dispute Resolution

These Terms are governed by California law. Any dispute will be resolved in the state or federal courts of Santa Clara County, California, unless the parties agree to binding arbitration.

14. Changes to Terms

We may amend these Terms at any time. Material changes will be posted at least 14 days before they become effective. Continued use of Wunderstood products or services after the effective date constitutes acceptance.
